INFORMATION AND SELLING CONDITIONS

We will be pleased to answer all your questions and, very important please, do not place any purchase order without having read the following terms and conditions.

Original works

The artworks displayed on this website are unique.

There are not, and there will not be in the future, any other copy of them, unless the artist is commissioned by the buyer, or by the legitimate owner, if the work is resold.

If the artist ever creates works for sale via printing, in numbered series, as NFT or in any other format that contradicts the previous two paragraphs, it would be clearly stated next to the image or images of the affected works. If the indication does not appear, it means that the piece of art fulfils all the details described in both paragraphs.

Prices, shipping and invoicing

The prices of the works shown in the Gallery do not include packaging, shipping or transport insurance costs.

The buyer has two options:

1. Arrange the collection, packaging and delivery by their own.

2. To ask the estimated cost if they want us to manage these services, in which case the additional costs will be added to the price of the work.

If the buyer handles all these aspects independently, we highly recommend contracting insurance to cover the risk of loss or damage during transport.

If we are in charge of the process, we will always arrange for such transport insurance.

All the works will be varnished and signed on the front by the artists, before shipping them.

On the reverse side of each work the following details will be handwritten: buyer’s name, title of the pieces, the technique used, dimensions, year of execution, date of sale, artist’s name and personal signature.

Included inside the package, the buyer will receive:

1. The corresponding certificates of authenticity.

2. An individual invoice for each work, detailing its price, taxes and the total amount.

3. A spare invoice for packaging, transport and shipping costs.

(The invoices can be sent by email in advance, once the payment is confirmed.)

If the works were bought from abroad, the export legitimacy certificate will be provided and attached to the outside of the package for customs recognition.

Methods of payment

The payments of the works must be made at the time the purchase is arranged. The following payment methods are accepted.

The artworks will be shipped once the payment has been confirmed.

Free return policy

If, once the work or works have been received, the buyer thinks, for any reason, that they do not match or fit with what can be seen in the gallery online, they will have fourteen days to return them.

Although we are confident this will not occur, we commit ourselves to fully refunding the buyer for the returned works.

The refund will be implemented once the works have been received back at the artist’s studio and their good condition has been verified.

The refund will not include the packaging, shipping, or transport insurance costs.

All procedures and expenses related to the return packaging, transport insurance, and return shipment will be as well on the buyer.

Buyers should also consider that the colours of the works displayed in the Gallery, as viewed on digital screens, might slightly differ from the originals, depending on various factors, especially the type of lighting under which they are viewed.

Rights

The buyer will be the only owner of the acquired work and will hold all the legal rights accordingly.

However, the buyer or legitimate owner, if the work has been resold, is not allowed to make copies, duplicates, or use them for speculative or commercial purposes, such as, for example, advertising campaigns for other products, without the express authorization of the artist.

The author, meanwhile, keeps the right to publish images of the sold works, in any printed or digital format, only for the purposing of including them in his portfolio of completed works, showing them to potential buyers, advertising his artistic offerings, and all other rights granted by law, especially those related to intellectual property.

Any legal dispute that may arise, regardless of its nature o cause, shall be submitted to the jurisdiction of the courts of Menorca.

Personal Data Protection

We are obligated to strictly and accurately complying with all legal and regulatory provisions concerning the protection of our buyers’ personal data.

Modification of terms

If any of the terms set out here do not fully comply with the current laws, they will be considered null and void.

Finally, we reserve the right to modify and improve these terms, always in compliance with the law in force at the time, and without any negative retroactive effects for those who made purchases under previous terms.
